The HawkNest platform, including the website, mobile application, and related features and functionalities (together, the “Platform”), is made available by UniHawk Education Support Services L.L.C, a company incorporated under the laws of the United Arab Emirates, with its registered address at Office 1113, Malik Hamad Suhail Owaida Al Khaili Building, Al Sufouh 2, Dubai, UAE (together “we”, “us”, “our” or “UniHawk”).
This Acceptable Use Policy (“AUP”) sets out the standards of conduct and permitted use applicable to all users of the Platform and is intended to ensure that the Platform is used in a safe, lawful, and responsible manner, including in compliance with applicable laws.
1) Purpose
This AUP sets out the rules and standards governing access to and use of the Platform and any related services made available by UniHawk.
This AUP is incorporated by reference into, and forms part of, the Terms of Service made available through the Platform. By accessing or using the Platform, you agree to comply with this AUP and the Terms of Service. Any breach of this AUP shall constitute a breach of the Terms of Service.
2) Who this applies to
This AUP applies to all users of the Platform, including:
- students (aged 13 and above),
- parents/guardians (where applicable),
- counselors, school administrators, and
- any other authorized users.
The users must comply with this AUP at all times when accessing or using the Platform.
3) Prohibited activities
You agree that you shall not, and shall not permit, assist, or enable any third party to:
3.1 Harmful or illegal conduct
- use the Platform in violation of any applicable law, regulation, or legal obligation;
- Harass, threaten, defame, or exploit any person, or group;
- Create, submit or share content that promotes, encourages, or facilitates violence or self-harm or other harmful activities; and
- engage in any activity that may cause harm to any individuals, including minors.
3.2 Child safety
- Access or use the Platform if you are under 13 or below the applicable age of digital consent in your jurisdiction, unless permitted with appropriate parental or institutional authorization;
- create, request, access, upload, store, or distribute any content that sexualises minors or constitutes child sexual abuse material (CSAM);
- engage in grooming, exploitation, or any conduct that may endanger the safety or well-being of a minor; or
- use the Platform in a manner inconsistent with applicable data and child protection laws, including the UAE Child Digital Safety Law.
3.3 Security and platform abuse
- Probe, scan, or test the vulnerability of the Platform or any related systems or networks.
- Circumvent or attempt to circumvent rate limits, access controls, or other restrictions.
- Attempt to access accounts, data, or systems without authorization.
- Introduce malware, ransomware, spyware, or other harmful code into or through the Platform.
3.4 Data scraping and automated extraction
- Scrape, harvest, or bulk-export data from the Platform unless explicitly permitted in writing.
- Use bots or automation that materially interferes with or disrupts the Platform.
- Misuse data obtained from the Platform in violation of applicable laws.
3.5 Misuse of AI features
- Request or generate or use outputs to facilitate or engage in unlawful, harmful, or improper activities.
- Use outputs to impersonate others or misrepresent identity.
- Use the Platform as the sole basis for high-stakes decisions affecting a person’s education, admissions, scholarships, immigration/visa, or employment.
- attempt to manipulate, exploit, or reverse-engineer AI systems or outputs.
3.6 Intellectual property and rights violations
- Upload or share content in respect of which you do not have the necessary rights, licences, or permissions.
- Infringe any copyrights, trademarks, or other intellectual property or proprietary rights.
- Misuse, reproduce, distribute, or misappropriate content generated through the Platform.
4) Enforcement
We may investigate any actual or suspected violations of this AUP and may take appropriate action, including:
- removing or disabling access to content,
- suspending or terminating accounts,
- restricting or blocking access to the Platform (including by organisation, IP address, or network),
- reporting to law enforcement or relevant regulatory authorities where required or appropriate.
Enforcement actions will be proportionate to the severity and nature of the violation. Where practicable, we will provide notice before taking action, except where immediate action is required for safety or legal reasons.

5A) UAE Child Digital Safety Law (CDS) obligations
UniHawk implements measures to protect the safety, privacy, and rights of children using the Platform, in accordance with applicable UAE laws, including the UAE Child Rights Law (Federal Law No. 3 of 2016) and the UAE Child Digital Safety Law.
In particular:
- content involving child sexual abuse material (CSAM) is strictly prohibited and will result in immediate action, including account termination and reporting to competent authorities;
- safeguarding incidents (including suspected grooming, exploitation, or exposure to harmful content) may be escalated and reported in accordance with applicable legal obligations; and
- users must promptly report any concerns relating to child safety through the designated reporting channels.

6) Cooperation with authorities
UniHawk may cooperate with law enforcement and regulatory authorities, where required by applicable law or where reasonably necessary to:
- comply with legal obligations;
- protect the safety of users or the public; or
- prevent or investigate unlawful activity.
7) Updates
We may update this AUP from time to time. We will post the updated version and update the effective date. Continued use of the Services after the updated AUP takes effect constitutes acceptance of the revised AUP.
